Online Terms of Sale
The terms that apply when you buy a printed artwork from us.
We are The Art Room, an online art gallery operating at theartroom.gallery (the "Website"). You can contact us at contact@theartroom.gallery.
These Terms apply to all purchases of products (the "Products") made through our website. By placing an order, you confirm that you are at least 18 years old, or have the legal authority to enter into a binding contract. If you do not agree with these Terms, you should not place an order.
We may update these Terms from time to time. The version in force at the time of your order will apply.
1. How our prints are made
The Art Room is a curated online gallery. We exhibit artworks by independent artists and offer fine-art prints made to order on their behalf.
All prints are produced by a specialist fine-art print partner. Each print is dispatched directly from the print partner and, where applicable, accompanied by a certificate of authenticity.
Because each print is produced on demand specifically for your order, please review the information below carefully — particularly the sections on production time, cancellation, and returns.
2. Orders and order acceptance
All orders are subject to acceptance by The Art Room.
After placing an order, you will receive a confirmation email. This email confirms receipt of your order, not its acceptance. A binding contract is only formed once we have reviewed and submitted your order to our print partner for production.
We reserve the right to refuse or cancel any order, including for:
Product unavailability
Errors in pricing, description, or images
Suspected fraud or unauthorized transactions
Inability to verify delivery details
If your order is canceled and your card has been charged, you will receive a full refund.
3. Pricing
Prices are listed in the currency displayed on the Website.
Prices exclude shipping unless otherwise stated.
Prices may change at any time before an order is confirmed.
If a pricing or description error is identified after you place an order, we will contact you and offer the option to proceed at the corrected price or cancel the order with a full refund.
4. Taxes, duties and customs
Depending on your delivery location:
VAT or sales tax may apply, as displayed at checkout.
Import duties and customs charges may be payable upon delivery for shipments outside the printer's home jurisdiction.
You are responsible for any such additional charges. We are unable to predict or refund customs duties.
5. Payment
We accept the payment methods displayed at checkout. All payments are processed securely by our third-party payment provider; The Art Room does not store or have access to your full payment details.
How we charge your card. When you place an order, the full amount is authorized on your card — you may see this as a pending hold. The amount is only captured (i.e. funds actually taken) once we have reviewed your order and submitted it to our print partner for production. If we cancel your order before submission, the authorization is released and no funds are taken.
You may be required to accept the third-party provider's terms as part of checkout.
6. Production and dispatch
All prints are produced to order. Typical lead times are:
Order review: within 1–2 business days of placement
Production: approximately 5–10 business days from production start (longer for framed pieces)
Delivery: depends on destination; shipping estimates are shown at checkout
Lead times are estimates. Production and shipping times may vary due to demand, framing options, and carrier conditions.
7. Title, risk and delivery
Title to the Product passes to you once we have received full payment and the Product has been delivered.
Risk of loss or damage passes to you on delivery.
You are responsible for:
Providing accurate delivery details
Paying any import duties or taxes
Being available to receive the shipment
If delivery fails due to incorrect address details or a missed delivery, additional shipping charges may apply for re-dispatch.
We are not liable for delays caused by customs, carriers, or other events outside our reasonable control.
8. Product appearance
We make every effort to display our artworks accurately. However:
Colors may vary depending on your screen, device, or browser.
Final prints may differ slightly from on-screen previews due to the nature of pigment printing on physical paper.
Frame and paper finishes are described as accurately as possible but may show minor variation as part of the production process.
Such minor variations do not constitute a defect.
9. Intellectual property
All artworks displayed on the Website remain the intellectual property of their respective artists. The Art Room sells prints on behalf of the artist under license.
When you purchase a print, you acquire the physical object only. You do not acquire:
Copyright in the underlying artwork
Reproduction or licensing rights
Any commercial usage rights
You may not reproduce, scan, distribute, or commercially exploit the artwork in any form without prior written consent from the artist.
Products are sold for personal, non-commercial use. Resale or commercial display without prior written agreement is prohibited.
10. Returns, refunds and replacements
Because all prints are produced to order, our returns policy is necessarily limited.
We accept returns or replacements only if the item arrives damaged, defective, or is not what you ordered.
We do not accept returns for:
Change of mind
Minor color or finish variations within normal production tolerances
Custom or framing choices made by you at checkout
If your order arrives damaged or incorrect:
Contact us at contact@theartroom.gallery within 7 days of delivery.
Include your order number and clear photographs of the product and the packaging it arrived in.
We will arrange a replacement or refund where appropriate.
Approved refunds are issued to the original payment method. Processing time depends on your bank or card provider.
11. Right of cancellation (EU consumers)
If you are a consumer resident in the European Union, you generally have a 14-day right to cancel under EU Consumer Rights legislation.
However, this right does not apply to goods made to the consumer's specifications or clearly personalized. Because every print on theartroom.gallery is produced specifically for your order, the 14-day cancellation right does not apply once we have submitted your order to our print partner for production.
You may cancel your order at any time before production begins by contacting us at contact@theartroom.gallery.
12. Liability
Nothing in these Terms limits liability where it would be unlawful to do so (including for death or personal injury caused by negligence, or fraud).
Subject to that, and to the maximum extent permitted by law:
Our total liability for any order is limited to the price paid for the affected Product.
We are not liable for indirect, incidental, or consequential losses.
We are not responsible for damage caused after delivery, delays outside our reasonable control, or minor variations in print appearance.
13. Data protection
We process your personal data in accordance with our Privacy Policy. Your information is used to:
Process your order and payment
Coordinate production and delivery with our print partner
Provide customer support relating to your order
We share the minimum necessary data (such as your name, delivery address, and order details) with our print and fulfillment partners strictly for order fulfillment.
14. Returns and cancellation summary
Returns accepted only for damaged, defective, or incorrect items.
Damage claims must be made within 7 days of delivery, with photos.
No returns for change of mind or framing/paper choices.
Refunds processed after verification, to the original payment method.
The EU 14-day cancellation right does not apply once production has begun.
